Nine senators chosen independently of government and opposition

The Senate has thirty-one members. Sixteen are appointed by the President on the Prime Minister's advice, six on the Opposition Leader's advice, and nine by the President in her own discretion from outstanding persons in economic, social or community organisations and other major fields of endeavour. The nine are therefore not delegates of the Government or Opposition.

A 15–15 division followed by a casting vote

All fifteen Government senators supported the Special Operations Bill. Six Opposition senators and all nine Independent senators voted against it. Senate President Wade Mark cast his vote with the ayes and declared the final result 16–15.

Safeguards, oversight and extraordinary powers

Independent senators raised objections concerning safeguards and oversight, the definition and leadership of special operations, limits on closed areas and curfews, detention, political influence and the Bill's qualified requirement for body-worn cameras. These were objections to the design and control of extraordinary State powers, not findings in support of criminal conduct.

‘Satan's helpers’, ‘satanic’, ‘demons’ and ‘scumbags’

The Trinidad Express and Trinidad Guardian reported Prime Minister Kamla Persad-Bissessar describing the Independent senators as ‘Satan's helpers’, ‘satanic’, ‘demons’ and ‘scumbags’, and accusing them of voting to protect violent criminals. These were the Prime Minister's characterisations; they were not findings about the senators or their reasons for voting.

Government would reject future Independent-bench amendments

Contemporaneous reports record the Prime Minister saying her Government would no longer accept amendments from Independent senators and that they had made themselves irrelevant. Independent Senator Anthony Vieira responded that scrutiny, disagreement and amendment are fundamental to the parliamentary process.

Unproven inducement allegations after an earlier Bill failed

After the related Zones of Special Operations Bill failed in January, the Prime Minister alleged that two unnamed Independent senators had sought personal favours for votes. The senators denied the allegation. The Law Association said unproven allegations of corruption undermined Parliament and public confidence. No evidence or names were produced in the public record cited here.
